1. ABOUT AMERICAN HOMECARE EQUIPMENT
American Homecare Equipment, Inc. is a licensed andaccredited provider of Durable Medical Equipment (DME), respiratory equipment,sleep therapy equipment, mobility products, and related healthcare services. Weprovide equipment, education, delivery, setup, maintenance, and support inaccordance with applicable federal and state laws, payer requirements,accreditation standards, and physician orders.

The information provided on this website is intended forgeneral educational and informational purposes only. It is not intended toreplace professional medical advice, diagnosis, or treatment. 4. PRESCRIPTIONS AND MEDICAL NECESSITY
Many products supplied by American Homecare Equipmentrequire a valid prescription or written order from a licensed healthcareprovider. Equipment is furnished only when medically necessary and whensupported by the documentation required by applicable insurance plans,Medicare, Medicaid, or other payers. The existence of a prescription does notguarantee insurance coverage or payment.
5. INSURANCE VERIFICATION
As a courtesy, American Homecare Equipment may verifyinsurance benefits and obtain prior authorizations when required. Insuranceverification is not a guarantee of payment. Final coverage decisions remainsolely with the patient's insurance company or health plan. Patients remainresponsible for deductibles, copayments, coinsurance, non-covered items,upgrades, convenience items, and any other amounts determined to be thepatient's responsibility under their insurance plan or applicable law.
6. PAYMENT TERMS
Payment for self-pay items is due at the time of purchaseunless otherwise agreed in writing. American Homecare Equipment reserves theright to collect unpaid balances, suspend non-emergency services wherepermitted by law, or pursue any remedies available under applicable law forunpaid accounts.
7. EQUIPMENT RENTAL AND OWNERSHIP
Certain equipment is provided on a rental basis, while otherequipment is purchased outright. Rental equipment remains the property ofAmerican Homecare Equipment unless ownership transfers under the applicablepayer guidelines or a separate written agreement. Patients agree to use rentalequipment properly, maintain it in reasonable condition, and notify us promptlyof loss, theft, damage, or malfunction. Equipment may not be transferred,modified, sold, pledged, or loaned to another individual without our writtenauthorization.
8. DELIVERY, SETUP, TRAINING, AND SERVICE
American Homecare Equipment provides delivery, setup,patient education, and equipment instruction consistent with applicableregulations and accreditation standards. Patients are responsible for followingall manufacturer instructions, physician recommendations, and safetyguidelines. If equipment requires service or repair, patients should contactour office immediately and should not attempt repairs involving electrical,mechanical, or structural components.
9. PRODUCT AVAILABILITY
Product availability is subject to manufacturer inventory,supply chain conditions, regulatory requirements, and insurance approval.American Homecare Equipment reserves the right to substitute substantiallyequivalent products when medically appropriate and permitted by applicablepayer requirements.
10. RETURNS AND EXCHANGES
Due to health and infection-control regulations, certainproducts cannot be returned after they have been opened or used unless requiredby law or unless the product is defective. This includes CPAP masks, cushions,tubing, filters, humidifier chambers, and other single-patient-use items.Defective products will be evaluated and exchanged in accordance withmanufacturer warranties and applicable law. Rental equipment will be retrievedwhen the rental period ends, coverage terminates, or the equipment is no longermedically necessary.
11. PATIENT RESPONSIBILITIES
Patients agree to provide complete and accurate information,including insurance information, physician information, prescriptions, anddelivery information. Patients also agree to notify American Homecare Equipmentpromptly of changes to their address, telephone number, physician, insurancecoverage, or medical condition that may affect equipment or services, and touse equipment only as prescribed while maintaining it in a clean and safecondition.
12. WEBSITE USE
You agree to use this website only for lawful purposes. Youmay not interfere with the operation or security of the website, introducemalicious software, attempt unauthorized access, or misuse any portion of thewebsite. American Homecare Equipment reserves the right to restrict orterminate access to users who violate these Terms.
13. INTELLECTUAL PROPERTY
All content on this website, including text, graphics,photographs, logos, trademarks, videos, software, forms, educational materials,and other content, is the property of American Homecare Equipment or itslicensors and is protected by applicable intellectual property laws. Certain equipment provided by American Homecare Equipment,including CPAP, BiPAP, non-invasive ventilation, home mechanical ventilation,oxygen equipment, and other connected medical devices, may electronicallytransmit equipment usage, compliance, performance, or diagnostic informationwhen supported by the manufacturer and authorized by applicable law or yourhealthcare provider. By accepting and using such equipment, you acknowledgethat equipment usage information may be transmitted to American HomecareEquipment, your prescribing physician, your insurance company or payer,equipment manufacturers, or other authorized healthcare providers for therapycompliance, equipment performance, reimbursement requirements, service support,patient follow-up, and regulatory compliance. Remote monitoring does notconstitute continuous medical monitoring or emergency medical supervision.Patients remain responsible for contacting their physician or emergency medicalservices whenever medically necessary.
18. ELECTRONIC, AUTOMATED, AND AICOMMUNICATIONS
American Homecare Equipment may communicate with patients,caregivers, referral sources, physicians, suppliers, or other authorizedindividuals through telephone calls, email, text messages (SMS), secure patientportals, automated messaging systems, artificial intelligence (AI)-assistedcommunication tools, virtual assistants, or similar technologies. Thesecommunications may relate to appointments, deliveries, equipment education,compliance reminders, supply replacement reminders, prescription renewals, billing,customer service, quality assurance, and training. Telephone calls may bemonitored or recorded where permitted by law. AI-assisted communications areintended to improve customer service efficiency and are not a substitute forprofessional medical judgment. Patients may request to speak with a liverepresentative whenever available. By providing your telephone number or emailaddress, you consent to receive these operational communications as permittedby applicable law. You may opt out of non-essential marketing communications;however, operational communications may continue where permitted or required bylaw.

23. SEVERABILITY
If any provision of these Terms is determined to be invalidor unenforceable, the remaining provisions shall continue in full force andeffect.

American Homecare Equipment may revise these Terms at anytime. The updated version will be posted on this website with a revisedEffective Date. Continued use of the website after changes become effectiveconstitutes acceptance of the revised Terms.
